If you provide any information that is untrue, inaccurate, not current or incomplete, or GE4S has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, GE4S has the right to suspend or terminate your account and refuse any and all current or future use of the GasEquipment4Sale.com Services (or any portion thereof). GE4S will use the Profile Data and other information known about the user to determine any additional access requests. GE4S holds the right to grant and deny access of any service including websites, information or other provisioned content to any user. All users will be considered equal and be granted access on a case by case basis.

For users of the GE4S equipment listing system (Program) you agree that you shall not use the Program for the selection of products manufactured by any company other than GE4S. You acknowledge the Program is only intended for the preliminary selection of GE4S products and that GE4S shall not be liable to the user for the results of such preliminary selection until and unless such selections are confirmed in writing, and in accordance with the GE4S Worldwide Terms and Conditions by an duly authorized representative of GE4S. The user agrees to indemnify and hold GE4S harmless for any and all actions or claims that arise out of the users failure to comply with these terms. The user acknowledges this the use of the Program may be terminated at any time for any reason, without the requirement of prior notice.

Compliance with U.S. Export/Reexport Controls and Economic Sanctions. This website is operated from servers located in the United States. GE4S makes no representation that its website (or the content and/or materials contained herein) is appropriate or available for use outside the United States. Access to the GE4S website from territories where its content and/or materials are illegal or restricted is prohibited. If you choose to access the GE4S website from outside the United States, you do so on your own initiative and you agree that your use of this website will be in full compliance with all relevant and applicable laws and regulations, which shall include but not be limited to, U.S. export/reexport controls and economic sanctions and under no circumstances to support terrorism or nuclear, chemical, biological weapons or missile development, production or proliferation. This agreement shall be governed by and construed in accordance with the laws of the State of Texas without regard to its rules governing conflicts of law. The parties agree that the exclusive venue for all actions and arbitrations relating in any manner to this agreement shall only be in a Federal or State court of competent jurisdictions located in Dallas County, Texas, U.S.A. If any provision of this Agreement is for any reason held unenforceable or invalid, then this Agreement shall be construed as if such provision were not contained in this Agreement. No action arising out of this Agreement may be brought by you more than two years after the date the cause of action has accrued. You may not assign this Agreement or any of its rights or obligations without the prior written consent of GE4S, and any such attempted assignment will be void.

Not withstanding anything else set forth herein, nothing in this Agreement will be deemed to have created a partnership, joint venture, franchise, employment, or any other agency relationship between GE4S and the Site user. Subject to the foregoing, this Agreement shall inure to the benefit of and be binding upon the permitted successors, legal representatives and assigns of the parties hereto. If any provision hereof is declared invalid by a court of competent jurisdiction, such provision shall be ineffective only to the extent of such invalidity, so that the remainder of that provision and all remaining provisions of this Agreement will continue in full force and effect.
